Learned advocate appearing on behalf of WBSEDCL, that is, the Tender Inviting Authority submits, upon instruction that, as the petitioner does not qualify either of the conditions mentioned in Clause 1(ii) (a) or (b), accordingly, the petitioner's bid stood cancelled.

Specific submission is that the petitioner is not enlisted under rate contract with WBSEDCL which is one of the eligibility criteria for participating in the tender process.

Learned advocate representing the petitioner asserts that the petitioner is an enlisted contractor. However, nothing has been annexed to the writ petition to suggest enlistment of the petitioner under rate contract with WBSEDCL.

In view of such disputed question of fact, the relief sought for by the petitioner cannot be allowed.

The writ petition fails and is hereby dismissed.
