Mr. Nandadulal Bandyopadhyay ...for the petitioner A direction to secure expeditious disposal of Title Suit No.110 of 2017, pending before the learned Civil Judge (Junior Division), 3rd Court, Paschim Medinipur, is the ultimate relief sought for in this case. The only contention expressed by the learned advocate for the petitioner is that the suit is getting delayed for the cross-examination of D.W.1 being deferred on the ground of adjournment being granted on the prayer of the opposite parties/plaintiffs No other point is raised requiring addressed by this Court.
In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.
Service upon the opposite parties stands dispensed with.
Accordingly, learned Civil Judge (Junior Division), 3rd Court, Paschim Medinipur, in Title Suit No.110 of 2017, is requested to ensure expeditious disposal of
pending suit, after completing the cross-examination of D.W.1, providing sufficient opportunity of hearing to either of the parties to this case, but without granting any unnecessary adjournment, unless it is extremely unavoidable.
While endeavouring such exercise, in the absence of any interlocutory application being preferred by either of the parties to this case, the logical conclusion of the suit may be reached, preferably within twelve
(12) weeks from the date of communication of this order, and being targetted in that the crossexamination of D.W.1 may be fixed on consecutive dates, if necessary, subject to suitability and convenience of the court, so as to dispense with the justice in a best possible and expeditious manner. Petitioner is directed to make communication of this order to the learned court below as well as to the opposite parties and their learned advocate in the court below.
With this observation/direction, the revisional application stands disposed of.
Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
