17.06.2022 sdas rejected C.R.M. (NDPS) 656 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Burdwan Police Station Case No. 383 of 2020 dated 22.06.2020 under Section 21(c ) of the NDPS Act.

Raj. ..... petitioner Mr. Saryati Datta Mr. Sanjib Kumar Dan ... for the petitioner Mr. Ranadeb Sengupta ... for the State Having considered the materials on record and bearing in mind the statements of the witnesses and as contemporaneous documents primarily showing recovery of narcotic substance above commercial quantity i.e. 4.6 liters of Codeine Mixture and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected. Trial court is directed to expedite the trial and conclude the same without granting any unnecessary adjournment to either of the parties.
