JM, 1st Court, Barasat being Misc. Case No. 13 of 2012.

The attention of this court has drawn to the earlier order passed on 13.12.2022 in CRR 1129 of 2018. It has been contended that since the order was passed, the parties appeared before the ld. JM, 1st Court, Barasat, the affidavit of assets and liabilities have been filed at the instance of the present petitioner but the o.p. no.2 has taken 11 dates for filing affidavit of assets and liabilities. In view of the contentions so advanced, I direct the ld. JM, 1st Court, Barasat that if the o.p. no.2 on the next date so fixed or, within a fortnight thereafter do not file the affidavit of assets and liabilities, the ld. JM, 1st Court, Barasat would by 31st of August, 2024 dispose of the application under section 127 of the cr.p.c.

No unnecessary adjournment be granted to any of the parties. The participating/representing advocates will not stall the proceedings on the date so fixed by the ld. JM in spite of any resolution of the local Bar.

With the aforesaid observations, CRR 1822 of 2024 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
