Learned counsel representing the petitioner submits that the husband of the petitioner was arrested despite compliance of the formalities under Section 41A of the Code of Criminal Procedure. Learned advocate representing the State respondents submits that the advocate of the noticee was present in police station, however, the noticee neither visited the police station nor met the investigating officer.

Learned advocate for the petitioner has failed to produce any document to substantiate that the noticee met the investigating officer in compliance of the notice under Section 41A. The investigating officer is present in Court. It has been submitted that the investigation of the case is nearly over and the same will be concluded shortly.

The investigating officer is directed to conclude the investigation in accordance with law at the earliest and place the report before the learned Trial Court.

Report filed by the Investigating officer signed on 24.06.2024 be retained with the records.

Parties are directed to take appropriate steps before the learned Trial Court where the matter is pending. The writ petition stands disposed of.

Urgent certified copy of this order, if applied for, be supplied to the parties expeditiously, on compliance of usual legal formalities.
