C.R.M. (M) 489 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Bagnan Police Station Case No. 210 of 2023 dated 19.05.2023 under Section 302 of the Indian Penal Code.

Ms. Sonali Das Mr. Atanu Ghosh ... For the State The petitioner is in custody for about 2 years and renews her prayer for bail. Learned counsel for the petitioner submits that 11 witnesses have already been examined and her further detention is not required.

Learned counsel for the State opposes the prayer. The complaint relates to heinous offence where the petitioner being the step mother of an 8 year old child has allegedly murdered him. Child used to reside with the petitioner in the house where he died. The petitioner owes an explanation to the circumstances which led to the said incident. 11 out of 17 witnesses have been examined. Only the official witnesses are left to be examined. Offences, if proved, shall attract mandatory life imprisonment.

Considering the gravity of the offence and prima facie involvement of the petitioner therein, the prayer for bail is rejected at this stage.

The trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.

The application is disposed of.
