This is an application for quashing of a proceeding in G.R. Case No. 385 of 2020 arising out of Jorabagan Police Station Case No. 49 dated 24.03.2020.
Learned counsel appearing on behalf of the petitioners submits as follows. During pendency of the proceeding, the disputes that had led to the registration of the FIR have been finally settled and compromised between the private parties. As such, the criminal proceeding may be quashed on the ground of compromise. Learned counsel appearing on behalf of the de facto complainant supports such contention of the petitioners and prays for quashing of the proceeding.
Learned counsel appearing on behalf of the State relies on the case diary and the statement of the alleged victim and the accused, subsequently recorded before a learned Magistrate pursuant to a direction passed by this Court. He submits that there is no injury report present in the case diary. The State would otherwise not come in the way if a settlement is arrived at between the private parties. It appears that a settlement has been arrived at between the private parties of all disputes that had led to the initiation of the impugned proceeding.
Accordingly, the impugned proceeding is quashed on the
ground of settlement and compromise.
CRAN 1 of 2025 and CRAN 2 of 2025 shall, accordingly, stand disposed of.
