Versus

State of West Bengal & Ors.

Mr. Ramashis Mukherjee, Mr. Debjyoti Maity ...for the Petitioner.

Mr. Arijit Chakrabarti, Mr. Shayak Chakraborty ...for the State-respondents.

Sk. Rejaul Alam ...for the Respondent No.5.

Affidavit-of-service is taken on record.

On the submission made by the respondent No.5 that he is willing to maintain his mother and allow her to reside in the premises in question, nothing remains to be decided in the writ petition.

The investigation in Sutahata Police Station Case No.179 of 2022 dated June 19, 2022 under Sections 341/323/506/34 of the Indian Penal Code read with Section 24 of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, which has been registered, shall be reached to its logical conclusion. It appears that the police authorities have already interrogated the respondent No.5 and his wife upon issuance of notice under Section 41A of

the Code of Criminal Procedure. The willingness of the respondent No.5 to maintain his mother, is recorded. Under such circumstances, the petitioner will approach the Officer-in-Charge, Sutahata Police Station on July 4, 2022 at 11:00 a.m. The police authorities shall escort the petitioner to the residence. Strict vigil shall be maintained in order to ensure that the petitioner is not disturbed. The writ petition is, thus, disposed of.

There will be no order as to costs.

All parties are to act on the basis of the server copy of this order.
