The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with. The respondent in an appeal being Title Appeal No. 02 of 2023 pending before the 1st Court of learned Additional District Judge at Barasat, District - 24 Parganas (North) arising out of a decree of eviction dated November 24, 2022 passed by the learned Civil Judge(Junior Division), Biddhannagar in the Ejectment Suit No. 69 of 2008 is the petitioner of the instant application.

The petitioner is praying a direction for expeditious disposal of the said appeal and the pending applications thereto.

Learned advocate for the petitioner submits that there are two pending applications, one for payment of occupational charges and another for vacating the order of stay passed in the said appeal. The appeal Court below is requested to dispose of the said pending applications as expeditiously as possible in accordance with law and shall make all endevaour to dispose of the appeal expeditiously, if the matter is otherwise ready for disposal. The appeal Court below, in doing so, shall not grant any unnecessary adjournment to either of the parties. C.O. 1603 of 2024 is thus disposed of without any order as to costs. The petitioner shall communicate this order to the opposite parties.
