Mr. Anirban Ray, Ld. G. P.

Mr. Raja Saha, Mr. Avishek Prasad ......for the State.

It is submitted by counsel for the parties that P.F. has been released to the legal heirs of late Manjusa Mallick (Mukherjee). Insofar as gratuity and one time death benefit is concerned, the same has been considered and declined.

It appears from the order dated 02.03.2021 that this Court had directed to consider the petitioner's request for release of gratuity and one time death benefit.

In that view of the matter, this Court notes that there is no contempt. The petitioner shall, however, be entitled to challenge the order of refusal of payment of gratuity and one time death benefit in accordance with law.

The contempt application is disposed of.

The presence of the alleged contemnor virtually is dispensed with.

The Rule issued shall stand discharged.

Interim order, if any, shall stand vacated.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
