This is an application for expeditious hearing of the Miscellaneous Appeal being No. 5 of 2021 pending before the learned Additional District Judge, 9th Court at Alipore.

It has been submitted by the learned advocate for the petitioner that September 30, 2021 is the date fixed for hearing of the Miscellaneous Appeal .

In view of the order sought and proposed to be passed, there is no necessity of issuing any notice upon the opposite parties. However, the petitioner shall be obliged to forward a copy of this application as well as this order upon the opposite parties or their learned Advocate in the Court below forthwith.

CO 1354 of 2021 is disposed of by requesting the learned Additional District Judge, 9th Court at Alipore to take up the hearing of the application on the next date fixed, i.e. on September 30.2021 if the same is otherwise ready for hearing, and to make endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
