The petitioner is aggrieved by the manner in which the investigation of Islampur Police Station Case No. 101 of 2025 dated 03.02.2025 is progressing. Earlier a grievance was canvassed that the petitioner was informed that HDFC Bank Account No.50200042219007, has been frozen.

Consequent to which a report was sought for. State has submitted a report which reflects specifically that the account has not been frozen in connection with Islampur Police Station Case No. 101 of 2025 dated 03.02.2025.

Petitioner secondly expresses his agony regarding the progress of the investigation.

The provision of Section 193 of BNSS specifically provides that after a period of ninety days, the informant/de facto complainant is entitled to know the progress of the investigation. In case the petitioner has not been notified, petitioner would approach the learned Magistrate for necessary information to be furnished by the investigating agency relating to the progress of the investigation, as the subject-matter of the case, even if the starting date is taken to be 3rd February, 2025 reflects that a period of ninety days has already expired.

Accordingly, if the petitioner takes out any appropriate application under the relevant provisions of Section 193 of BNSS, learned Magistrate in seisin of Islampur Police Station Case No. 101 of 2025 would pass necessary directions under the relevant provisions of BNSS.

Learned advocate appearing for the private respondent nos. 7, 8 and 9 denies and disputes so far as the accusations made in the writ petition are concerned and reserves the right to canvass the issues at the appropriate stage of the case.

Having regard to the observations made above, further pendency of the writ petition is unwarranted.

Accordingly, the writ petition being WPA 11454 of 2025 is disposed of.

There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
