Sk Mosaraf Hossain And ORS v. State Of West Bengal And ORS.
01.07.2022 Sl. No.74 srm W.P.A. No. 10760 of 2022 Sk. Mosaraf Hossain & Ors.
Versus
The State of West Bengal & Ors.
Mr. Sabyasachi Chatterjee, Mr. Pintu Karar, Mr. Akashdeep Mukherjee, Mr. Badrul Karim ...for the Petitioners.
Mr. Debasish Ghosh, Mr. Ratul Das ...for the State-respondents.
Mr. Sukanta Chakrabarty, Mr. Anindya Halder ...for the Respondent No.6.
Affidavit-of-service is taken on record.
It appears that writ petition has now become infructuous in view of the fact that the meeting which was scheduled to be held on June 20, 2022, has been re-scheduled. It is submitted by the respondents that the petitioners have not been able to make out a case that there was a threat to their safely and security. The complaint filed before the Officer-in-Charge, Jagatballavpur Police Station is against a local MLA, who has not been added as a respondent in this writ petition.
However, if the police authorities receive any complaint with regard to any apprehension of breach of peace and/or
violence, the police authorities shall take appropriate steps, in accordance with law.
As no affidavit-in-opposition has been called for, the allegations are deemed to be denied.
The writ petition is, thus, disposed of.
There will be no order as to costs.
All parties are to act on the basis of the server copy of this order.
