Ms. Swarnali Saha Mr. Khaja Samshad Ahmed ... for the petitioner. This is an application wherein petitioner has prayed for expeditious disposal of the Complaint Case No. CS/51664/23 under section 25 of Payment of Settlement System Act, 2003 which is pending before 5th Metropolitan Magistrate, Calcutta. Having heard learned counsel for the petitioner it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein the opposite parties will have no cause to prejudice, as such service of copy of application upon the opposite parties is dispensed with. Petitioner justified his prayer submitting that the last date was fixed on 27th January, 2025 and the next date is fixed on 21st January, 2026.

Having considered, the instant application being CRR 2253 of 2025 is hereby disposed of with a direction upon the court below to make every endeavour for expeditious disposal of the case and to make its best efforts to conclude the proceeding preferably within a period of three months from the next date of hearing. This order is passed invoking this court's jurisdiction under section 529 of the BNSS.
