Chakraborty Mr. Arindam Poali ...for the Petitioner Mr. Aniket Mitra Ms. Afreen Bagum ...for the State It is submitted on behalf of the petitioner that 453 gms. of brown sugar was allegedly recovered from the possession of the present petitioner. However, no videography was done nor the ground of arrest was communicated to the petitioner at the time of arrest. He is in custody since 30th January, 2025 and as such, he may be released on bail on any terms and conditions.

Learned counsel appearing on behalf of the State opposes the bail prayer contending that the case diary reveals that videography was done and furthermore, investigation is still continuing and that commercial quantity of narcotic substance was recovered from the possession of the petitioner and as such, he opposes the prayer for bail.

Having heard the learned counsel appearing on behalf of both parties and that the rigour of Section 37 of NDPS Act clearly attracts in respect of the present petitioner.

Accordingly, the prayer for bail is rejected. Accordingly, C.R.M. (NDPS) 600 of 2025 is disposed of. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
