Complaining inaction on the part of the municipal authorities to take further steps in relation to the self demolition order passed by the municipal authorities, the instant writ petition has been filed. 3.

The learned advocate appearing for the petitioner has drawn attention of this Court to the communication dated 22nd March 2023 and would submit that the Board of Councilors of UttarparaKotrung Municipality have already come to a conclusion that an unauthorized construction has been carried on at 135 JK Street, Ward no.19, Uttarpara, Hooghly. The construction is beyond the sanction plan dated 3rd August 2022 and accordingly the self demolition order dated 21st February 2023 has been issued. It is submitted that although, the

municipal authority had issued a communication dated 22nd March 2023 to ensure compliance of the aforesaid order, the private respondents are not adhering to the self demolition order. The municipal authorities had not taken any steps, thereafter. 4.

At the time of call the municipality is not represented, though the State is represented. 5.

Having heard the learned advocates appearing for the respective parties and noting that the municipal authorities had already passed a self demolition order, without going into the controversy at this stage as to whether the aforesaid order has been complied with by the private respondents, I am of the view that in the fitness of things it would only be prudent to direct the municipal authorities to carry out an inspection of the locale and find out whether the self demolition order has been carried out and if, the same has not been carried out to implement the same in accordance with law, unless there be any impediment in implementing the same.

With the above observation and direction, the writ petition is disposed of.
