23.05.2025 Court No.28 Item No.19 ssi CRM (A) 1734 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Andal PS Case No.418 of dated 26.11.2024 under Sections 85/115(2)/75/109/316(2)/3(5) of the BNS 2023. And In the matter of: Ashesh Narayan Singh ....Applicant/Petitioner.

Mr. Sujan Chatterjee Mr. Juin Dutta Chakraborty Mr. Debnarayan Patra Mr. Bidan Modak Ms. Arpita Kundu ...for the petitioner Mr. Md. Adil Badr Mr. Sujoy Sarkar ..for the State Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the husband of the alleged victim. The marriage took place in 2018. After the alleged date of occurrence i.e., 30.09.2024, the wife went to the paternal home and came to know about the filing of a matrimonial suit by the petitioner. After that, she lodged the instant FIR. The sister in law was granted anticipatory bail on 21.05.2025 in CRM (A) 1660 of 2025.

Learned counsel for the State refers to the injury report and the statements of witnesses available in the case diary. It appears that the injury allegedly inflicted was simple in nature. In view of the materials available in the case diary, the fact that a co-accused was granted anticipatory bail and that charge sheet has already been submitted, I am inclined to grant anticipatory bail to the petitioner.

In the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner shall not threaten or intimidate witnesses and shall attend the jurisdictional Court on dates fixed. The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
