Kausik CRM (NDPS) 1123 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with STF Police Statiion Case No. 02 of 2024 dated 12.01.2024 under Sections 21(C)/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that petitioner is in custody for 2 years and 6 months and similarly placed accused person has been granted bail by the Hon'ble Supreme Court in Special Leave to Appeal (Crl.) No. 1902 of 2026.

Learned Public Prosecutor appearing for the State opposes the prayer for bail and submits that petitioner is not similarly situated as the other accused person who has been granted bail.

I have taken into account the quantum of recovery in the present case and the fact that the trial is progressing very

slowly, as a matter of last chance, State is granted an opportunity to complete rest of the witnesses within a period of 4 months. In case, in spite of co-operation extended by the petitioner, rest of the prosecution witnesses are not completed within a period of 4 months, learned Trial Court will release the petitioner on bail on such terms and conditions as he thinks fit and proper.

Accordingly, CRM (NDPS) 1123 of 2026 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
