Heard the submissions of the learned advocate for the petitioner emphasizing the conduct of the opposite parties as well as the learned Trial Court. The learned advocate for the petitioner further drew attention of this Court to the order dated August 11, 2023, passed by the Hon'ble Supreme Court of India directing, inter alia, the Commercial Court at Alipore to expedite the hearing of the suit. Learned advocate for the petitioner submits on several occasions the learned Trial Court has entertained certain applications with regard to limitation which have already been decided by the Division Bench of this Hon'ble Court.

The learned Trial Court is to take note of the direction of the Hon'ble Supreme Court passed vide order dated August 11, 2023 and take necessary steps to dispose of the suit as expeditiously as possible preferably within six months.

In such situation the instant revisional application is disposed of.
