The revisional application was preferred challenging the orders dated 26.03.2012 and 12.04.2012 passed by the learned Metropolitan Magistrate, 8th Court, Calcutta in connection with C-Case No. 7140 of 2011. Records of this revisional application reflects that a co-ordinate Bench of this court was pleased to stay the warrant of arrest and directed that if the petitioner surrendered before the learned Magistrate, the learned Magistrate should release the petitioner on bail as the substantive offence complained of is a bailable offence.
The other grievance of the petitioner happens to be the issue of consideration of the application under Section 205 of the Code of Criminal Procedure. In case, the petitioner appeared before the court pursuant to the order passed by a co-ordinate Bench of this court, the learned Magistrate is directed to dispose of the application under Section 205 of the Code of Criminal Procedure if the same has not already been disposed of till date.
No further issues are involved in this revisional application. As such, the present revisional application being CRR 1698 of 2012 is dismissed.
All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
