Affidavit-of-service filed on behalf of the petitioner is taken on record.

A complaint was lodged by the petitioner before the concerned police authorities alleging that petitioner was duped by the respondent no.10 in selling a piece of land by executing conveyance deed.

Subsequently, it is also alleged that piece of land which was shown to the petitioner for transferring the same in his favour was not the land which was sold out in favour of the petitioner.

Petitioner prays for direction upon the concerned authority for entrusting the investigation with Criminal Investigation Department (CID).

State respondents and respondent no.10 are

represented by learned advocates who have opposed this writ petition.

On behalf of the State respondents a communication date 18th June, 2026 of Inspectorin-Charge, Baruipur Police Station, Baruipur Police District is filed today and same is taken on record. Copies of the communication dated 18th June, 2026 are made over to the learned advocates representing the petitioner and respondent no.10.

It is disclosed on behalf of the respondents that petitioner filed a Title Suit being No.602 of 2024 before the civil court and same is pending.

In addition thereto, based on the complaint lodged by the petitioner one criminal prosecution is initiated being Baruipur Police Station Case No.413 of 2026 dated 25th February, 2026 under certain provisions of BNS, 2023.

In view of pendency of suit before the civil court and initiation of criminal prosecution being Baruipur Police Station Case No.413 of 2026 dated 25th February, 2026, at this stage Court is not inclined to pass order for transferring the investigation to CID.

10. However, police authorities are directed to take the investigation to its logical conclusion expeditiously by taking steps in accordance with law and file report before the jurisdictional Magistrate.

11. The writ petitions stands disposed of.

12. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
