Mr. Mahadeb Sarkar Mr. Bikash Chowdhury ...for the petitioner Mr. Amal Kumar Sen Mr. Lal Mohan Basu ...for the State The petitioner is valid permit holder of auto rickshaw and complains that the Secretary, RTA, Nadia being the 4th respondent herein, is issuing permits to new auto rickshaws in violation of the notification no. 268-WT/3M01/2010 Pt.-1 dated 29th January, 2010. The petitioner submitted a representation in this regard before the concerned authority on March 01, 2024 which is yet to be considered. The petitioner prays for a direction upon the authority to consider the representation at the earliest. Learned counsel for the respondents submits that the 4th respondent be directed to consider the representation in accordance with law.

In view of the above, the writ petition is disposed of directing the 4th respondent to consider and dispose of the representation dated March 01, 2024 within six weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all the stake holders including the petitioner, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
