The charge is under Sections 21(b)/25/29 of the NDPS Act. Intermediate quantity of narcotics was allegedly recovered from the petitioner and co-accused. The coaccused has been granted bail by a coordinate Bench by an order dated May 10, 2024. The petitioner claims that he is similarly circumstanced and claims parity.

Learned advocate for the State says that the petitioner indeed stands on the same footing as the coaccused, who has been granted bail. We are, therefore, inclined to enlarge the petitioner on bail.

Accordingly, we direct that the petitioner, namely, Krishnendu Das @ Bubul, shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand), with two sureties of like amount each, one of whom must be local, to the satisfaction of learned Judge, Special Court under NDPS Act-cum-learned Additional Sessions Judge, 3rd Signed By :

Court, Paschim Bardhaman. The petitioner shall appear before the trial Court on every date of hearing until further orders and shall not intimidate the witnesses and/or tamper with evidence in any manner whatsoever.

In the event the petitioner fails to appear before the trial Court without justifiable cause, the trial Court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.

The application for bail being CRM (NDPS) 809 of 2024 is, thus, allowed.

All parties shall act on the server copies of this order duly downloaded from the official website of this Court. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities.
