The petitioner is an adopted son of a teacher of a primary school who expired on 31.10.2009. The said primary teacher, according to the petitioner, took adoption on 16.10.2009. The petitioner claims compassionate appointment and the pensionary benefit which, in my view, cannot be granted as the learned advocate has failed to show any rule to the effect that after attaining majority, the adopted son can make a claim for compassionate appointment. Apart from that the date of adoption and the date of expiry of the said teacher are in close proximity which raises a doubt. The teacher expired on 31.10.2009 and he took the adoption

on 16.10.2009. This close proximity is extremely doubtful.

I do not find any merit in this writ application and for the reasons as aforesaid, the writ application is dismissed.
