akb Mr. Nirmalya Kumar Das ...For the Appellants Re.: IA. No. CAN 3 of 2022 (Recalling) This is an application for recalling the order dated 15th June, 2016 which was passed in compliance with an order passed by a Division Bench of this Court dated 11th April, 2016.

In such view of the matter, liberty is given to the petitioners/appellants to move before the appropriate Bench. It further appears that some connected applications were disposed of vide order dated 26th July, 2023 as it was not pointed out before this out that the Second Miscellaneous appeal, being S.M.A. 9 of 1999 has already been dismissed vide order dated 15th June, 2016 read with order dated 11th April, 2016.

In such view of the matter, the order dated 26th July, 2023 is hereby recalled.
