In this application, the petitioners have prayed for a direction upon the court below for expeditious conclusion of the impugned proceeding being TR No.475/2024 in connection with GR Case No.491/22 presently pending before the learned Judicial Magistrate, 2nd Court, Kalna, Purba Bardhaman. Being aggrieved by the inordinate delay caused in disposing of the said proceeding, learned counsel for the petitioners submits that the instant case was registered on 5th April, 2022. After the completion of investigation, police submitted charge-sheet on 28th June, 2022. Thereafter, copies were also served upon the accused persons and the charge was framed on 3rd November, 2023. Since then, not a single witness has been examined and the next date is fixed on 11th August, 2026. He further submits that prosecution proposes to examine 6 witnesses.

Having heard the learned counsel for the petitioner, it appears that the prayer made by the petitioners is innocuous

and if it is allowed in terms of the prayer made in the application, the opposite parties will have no cause to prejudice. Having considered the submissions that the proceeding has practically stalled since 3rd November, 2023, I find that the prayer made by the petitioners is justified and required to be allowed to secure the ends of justice.

In view of the above, the instant application being CRR 2198/2026 is hereby disposed of with a direction upon the court below to make every endeavour to expedite the trial and to make his best effort to dispose of the said application preferably within a period of 3 months from the next of hearing. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all formalities. (Dr. Ajoy Kumar Mukherjee, J.)
