The petitioner being aggrieved by the issuance of warrant of arrest order passed by learned Judge, 3rd Special Court, Malda, in Special Case No. 31 of 2020 on dated 17.12.2024, has preferred the instant application.

It is submitted on behalf of the petitioner that petitioner obtained bail from the court below on 13.08.2020. Thereafter he was attending the Court but since he is suffering from different ailments, on the particular date he could not take steps and learned court below has issued warrant of arrest against him. Now, the petitioner intends to surrender before the court below.

Mr. De, learned counsel, who usually appears before the court on behalf of the State is hereby appointed to represent the State. Concerned authority is directed to regularize the appointment of Mr. De.

Having heard learned counsel appearing on behalf of the petitioner and the State, the instant application being CRR 2263 of 2025 is hereby disposed of giving liberty to the petitioner to surrender before the court below within a period of two weeks from this date and in the event of such surrender by

the petitioner before the court below the court below will dispose of his prayer in accordance with law without being influenced by any observation made hereinabove. The impugned order dated 17.12.2024 by which warrant of arrest was issued against the petitioner is stayed for a period of two weeks or till the petitioner surrenders before the trial court, whichever is earlier.
