Petitioners are aggrieved by the continuance of the proceedings of Bhadreswar Police Station Case No.235 of 2023 dated 23.05.2023. The investigating agency on conclusion of investigation submitted charge-sheet under Sections 498A/406 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

I have considered the statements in the background of the applicability of the sections. Having regard to the same, I am of the opinion that the petitioners would first canvass all the issues before the learned Magistrate in seisin of the matter. Accordingly, petitioners are granted liberty to file an application under Section 239 of the Code of Criminal Procedure. Needless to state that the learned Magistrate would dispose of the said application in accordance with law and without being influenced by any observations made by this Court while disposing of the revisional application.

With the aforesaid observations, CRR 1833 of 2024 is disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
