17.06.2022 sdas rejected C.R.M. (NDPS) 664 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Dewandighi Police Station Case No. 195 of 2021 dated 02.12.2021 under Sections 21(c ) of the NDPS Act.

And In Re : Faroz Ali Shaikh @ Faroj Ali Sekh @ Foraj Ali Sk. @ Feroz Ali Shaikh. ..... petitioner Ms. Sreyashee Biswas Ms. Benajir Hasna ... for the petitioner Mr. Sanjoy Bardhan Ms. Debjani Dasgupta ... for the State Having considered the materials on record and bearing in mind the statements of the witnesses and as contemporaneous documents showing recovery of narcotic substance above commercial quantity i.e. 1.5 Kgs. of Codeine Mixture from the petitioner and in view of statutory restrictions under Section 37 of the NDPS Act and as his prayer for bail was rejected earlier, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected. Trial court is directed to expedite the trial and conclude the same without granting any unnecessary adjournment to either of the parties.

Department is directed to communicate the order to the trial court for necessary compliance.
