We have considered the materials on record. On the leading statement of the petitioner initially 37.5 kgs. of Ganja was recovered from the co-accused. Petitioner was arrested. On his leading statement 21 kgs. of Ganja was recovered from his residence.

Keeping in mind the aforesaid facts disclosing role of the petitioner in dealing in narcotics above commercial quantity and in the light of the statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to him. The application for bail is, thus, rejected.
