Learned advocate appearing for the petitioner is 23.06.2025 Court No. 35 Item No.30 Rakib aggrieved by the fact that in spite of status quo orders passed by the learned Civil Judge (Senior Division), Diamond Harbour, the private respondents had been carrying out the construction work in violation of the order so passed by the learned Civil Court in T.S. No. 430/2018.

Learned advocate appearing for the private respondents submit that the private respondents were never informed by the learned trial Court advocate regarding the status quo order, as such the construction work was progressing, however, immediately on receipt of the information a copy of the writ petition relating to such construction work has been stopped. Learned advocate undertakes that the construction work will henceforth never proceed without the permission of the learned Civil Court which is in seisin of T.S. 430/2018.

State has submitted a report. Report reflects that the police authorities are in knowhow of the present situation prevailing, they are directed to keep surveillance and see that the undertaking given by the learned advocate for the private respondent nos. 9 to 11 before this Court are not violated. Police authorities will also keep a vigil so that no untoward incident results because of the strained relationship existing between the parties. With the aforesaid observations WPA 11522 of 2025 is disposed of.

Report so submitted by the State be kept with the record.

Copy of the report be handed over to both the parties.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
