None appears on behalf of the respondent nos. 11 to 14.

The allegation is of unauthorized construction over premises no. 14/3, Balu Hakkak Lane, P.S. Karaya, Kolkata 700 017.

The learned advocate for the Kolkata Municipal Corporation submits a short report indicating that upon inspection it revealed that the alleged construction was not in deviation of a sanction plan. The police authorities have also filed a report, from which it appears that the sanction plan for construction of a G+III building was issued by the Kolkata Municipal Corporation.

From the Corporation's report also, it appears that G+III

residential building has been constructed in terms of sanction plan and no deviation as yet has been found at the time of inspection.

The work shall continue only in accordance with the sanction plan for completion of the G+III building. The Corporation shall keep vigil and ensure that no unauthorized construction takes place. If the petitioner finds any further deviation then the petitioner shall be at liberty to approach the appropriate authority in accordance with law. This writ petition is disposed of.

There will be, however, no order as to costs. Parties are directed to act on the basis of the server copy of this order.
