The charge against the petitioner is under Sections 489B/489C IPC i.e. dealing in fake currency. Apparently, fake Indian currency of the value of approximately Rs.2,85,500/- was recovered from the possession of the petitioner. The petitioner says that he is in custody for about one year and two months. When this application was moved, charges had not been framed. By an order dated May 6, 2024, a Coordinate Bench had called for a report from the State regarding the status of the proceedings and the reason for delay. Such a report is filed in Court today. It appears that after the last order of the Coordinate Bench, charges have been framed on 5.6.24.

We understand that there are 19 witnesses. Witness action is yet to begin. Given the gravity of the charges against the petitioner and the prima facie incriminating evidence against him as found in the case diary, we are not inclined to allow the prayer for bail, at this stage.

The prayer for bail is, accordingly, rejected. However, since the petitioner has been in incarceration for a long period of time, we direct the learned Trial Court to expedite the trial as much as possible and bring the same to its logical conclusion at the earliest and preferably within a period of one year from the date of communication of this order. In the event the trial is not concluded within the aforesaid time period, the petitioner may renew his prayer for bail.
