Learned advocate for the petitioner claims that the property under reference belongs to his father and he has been enjoying the same for the last 38 years.

The further accusation is that the private respondents are trying to grab his property.

Learned advocate for the private respondents is present and submits that T.S. 131 of 2024 is pending before the learned Civil Judge (Jr. Divn.), Kharagpur,

Paschim Medinipur. Initially, an order of restraint was passed, but, subsequently, the same has been vacated as submitted by the learned advocate for the private respondents.

Be that as it may, State has submitted a report which reflects that the police authorities have already drawn up a proceeding under Section 126 of the BNSS to keep peace and tranquility in the area.

Having considered the nature of the dispute complained of as also the fact that the civil court is already in seisin of the matter, the police authorities would restrict themselves to ensure that no breach of the peace and/or tranquility takes place as also no untoward incident results because of the inimical relationship existing between the parties.

With the aforesaid observations, WPA 11604 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.
