(NDPS) 607 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure, 1973 corresponding to Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with NCB Crime No. 50/NCB/KOL/2017 dated 31.08.2017 under Section 8(c) read with Sections 20(b)(ii)(B)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned advocate appearing for the petitioner has prayed for confirmation of the interim bail which was granted on 01.07.2025. There were conditions imposed relating to meeting the O.C. of Howrah Maidan Police Station thrice in a week as also not to leave the geographic limit of district Howrah without the leave of the Trial Court. An additional condition is also reflected in the earlier order that the petitioner shall not be absent on any day during trial and shall not commit any offence while on interim bail. The Order No. 108 dated 21.11.2025 has been submitted by the learned advocate appearing for the NCB which reflects that after 11.08.2025, the petitioner is not complying with the conditions relating to meeting with the

Officer-in-Charge, Howrah Maidan Police Station as also he is not appearing before the learned Special Court. The Narcotic Control Bureau has also filed an application for cancellation of bail.

Having considered the totality of the circumstances, the interim bail granted is restricted till 18th January, 2026. The petitioner, in the meantime, would appear before the learned Special Court for confirmation of the bail. Learned Special Court would hear the application for cancellation of bail which has been preferred by the NCB along with the application for confirmation of bail, if any, filed by the petitioner within the aforesaid period. Photostat copy of the Order No. 108 dated 21.11.2025 submitted by the learned advocate appearing for the NCB be kept with the record.

With the aforesaid observations, the application for bail, being CRM (NDPS) 607 of 2025, is disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
