Anup Das v. State Of West Bengal

In connection with Ranaghat police station case no. 144 of dated 14th March, under Sections 126(2)/115(2)/118(2)/351(2)/3(5) of the BNS.

1. It is alleged that the petitioner's who are neighbours were taunting and abusing the daughter-in-law of the de-facto complainant. When they started to assault her, the defacto complainant and his son came to rescue her. But, they were attacked. They received serious injuries.

2. From the statements of witnesses available in the case diary including that of alleged eye-witness contained at page 8 of the case diary, it appears that one of the accused assaulted the victim with a brick bat.

3. Considering the incriminating materials available in the case diary and the injury reports, I am not inclined to grant anticipatory bail to the petitioner.

4. Accordingly, the application for anticipatory bail is rejected.
