Learned advocate appearing for the petitioner submits that petitioner is in custody for more than 1 year and 2 months and till date witness action has not commenced. It has also been submitted that prosecution has relied upon 9 witnesses in support of its case. As such, the petitioner, being a lady, be released on bail.

Learned advocate for the State, on the other hand, submits that the recovery was from the present petitioner which is 610 Gms. of Brown Sugar. Witness action would commence on and from 03.07.2026.

Having considered the quantum of seizure, I am of the opinion that the rigors of Section 37 of the NDPS Act is

attracted. Considering the period of detention of the present petitioner, I direct the present petitioner to renew her prayer for bail after the evidence of the seizure list witnesses are over. Learned Trial Court would give priority to the evidence of the seizure list witnesses which should be completed within a period of 3 months from the next date fixed. At this stage, CRM (NDPS) 1115 of 2026 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
