According to the petitioner, he intends to set up a showroom of Royal Enfield motor bike. To that extent, he was allured by the private respondents and/or deceived in respect of certain amount of money. The petitioner informed the local police station on or about 15.04.2024, but, till date, the police authorities did not take

any action.

Learned advocate for the State has submitted a report, which reflects that on the basis of a complaint of the respondent nos. 11, Baranagar P.S. Case No. 181 of 2024 dated 03.05.2024 was registered for investigation.

Learned advocate for the private respondents submits that, in fact, they have been cheated and the petitioner has approached this Court with a purpose of initiation of police action with an ulterior motive.

Be that as it may, as the petitioner informed the concerned police station, if he is aggrieved, he will follow the regular statutory procedures and approach the learned jurisdictional Magistrate for appropriate relief(s) under the relevant provisions/sections of law.

Having considered the nature of the accusations, I am of the view that the jurisdiction of this Court under Article 226 of the Constitution of India need not be invoked.

With the aforesaid observations, WPA 12477 of 2024 is disposed of.

Pending application(s), if any, is also disposed of.
