The petitioner challenges an adoption document of her biological child relied upon by the private respondent, Florence Mousumi Rozario. She wants visitation rights.

Counsel for the private respondent submits that his client has received the child and has lawfully adopted her.

The Entally Police Station submits that the child is hale and hearty. The child is studying in Class-I in Loreto Convent, Entally.

The dispute between the petitioner and the private respondent with regard to the custody

of the child may be agitated in an appropriate civil forum.

Counsel for the private respondent submits that the petitioner has instituted civil suit being T.S. 912 of 2023 before the 7th City Civil Court at Calcutta with regard to the legality of the order of adoption. Appropriate civil and/or statutory remedies may be sought by the parties with regard to the custody of the child in question.

The private respondent undertakes to keep the child in good physical and mental health and take good care of her.

With the aforesaid observations, the instant writ petition shall stand disposed of.

8.

There shall be no order as to costs.

9.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
