23.05.2025 Court No.28 Item No.23 ssi CRM (A) 1738 of 2025 In Re: - An application for anticipatory bail under Section 482 of the Bharatiya Suraksha Nagarik Sanhita in connection with Sagarpara PS Case No.127 of 2021 dated 25.07.2021 under Sections 341/325/326/307/34 of the Indian Penal Code.

Mr. Somnath Adhikary ....for the petitioner Mr. Imran Ali Mr. Abhishek Verma ..for the State It appears that in the instant case, several victims received injuries. Out of them, Rinku Mondal, received grievous injury. According to the statement of the said Rinku Mondal, it was the present petitioner, Kabil Mondal, who gave a blow on his body with a "henso".

Considering such materials, it cannot be said that the petitioner is on the same footing as one Rajjak Mondal who was granted anticipatory bail by this Court on 25.07.2022 in CRM (A) 3503 of 2022.

Considering the grievous nature of the injury and the alleged role ascribed to the present petitioner in inflicting such injury, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, the prayer for anticipatory bail to the petitioner is rejected.
