It is contended by the learned advocate representing the petitioner that pursuant to the order dated 14th May, 2018 passed on a writ petition being WPA 4762 of 2018, no order was passed by the District Inspector of Schools (P.E.), North 24 Parganas. Petitioner being differently abled son of a deceased teacher, who worked in a primary school, prays for family pension.

Learned advocate representing the State respondents has filed relevant documents wherefrom it appears that District Inspector of Schools (P.E.), North 24 Parganas passed an order on 24th July, 2018 after hearing the petitioner in the present writ petition. In the said order dated 24th July, 2018 it was recorded by the concerned District Inspector of Schools (P.E.) that due to failure to submit certain documents in support of claim of the petitioner, family pension case could not be settled.

In the present writ petition order dated 24th July, 2018 is not under challenge. In addition thereto nothing is found from the record wherefrom a conclusion can be derived that in terms of the order dated 24th July, 2018 necessary documents were submitted by the petitioner before the concerned District Inspector of Schools (P.E.) for settling family pension case.

A copy of the order dated 24th July, 2018 is made over to the learned advocate representing the petitioner.

In view of the aforesaid situation, no relief can be granted to the petitioner.

Hence, writ petition stands dismissed without any order as to costs.

However, this order shall not preclude the petitioner to take steps, in accordance with law, by submitting necessary documents before the District Inspector of Schools (P.E.), North 24 Parganas in support of claim of family pension.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
