Allowed C.R.M. (A) 1741 of 2025 In Re : An Application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Raghunathganj Police Station Case No. 487 of 2025 dated 14.04.2025 under Sections 85/80(2)/3(5) of the Bharatiya Nyaya Sanhita and Section 4 of the Dowry Prohibition Act.

And In Re : Patani Bibi and Anr.

Mr. Sandip Chakrahborty Mr. Koustav Das ... For the Petitioners Mr. Binoy Kr. Panda Ms. Ankita Paul ... For the State.

Learned counsel for the petitioners submits that the petitioners are the aged mother in law and the married sister in law of the victim and are innocent. Allegations against them are general and omnibus.

Learned counsel for the State opposes the prayer. It appears that the death of the victim is suicidal in nature. The petitioners appear to be mother in law and the married sister in law of the victim. No specific overt act has been attributed to the petitioners. Allegations against them are general and omnibus.

In view of the above, this Court directs that in the event of arrest, the petitioners namely Patani Bibi and Sahatun Bibi be released on bail upon furnishing a bond of Rs.10,000/-each, with two sureties of like amount each, to the satisfaction of the Arresting Officer and also subject to

the conditions as laid down under Section 482(2) of the BNSS. The petitioners shall appear before the jurisdictional court and pray for regular bail within two weeks from date. The application for anticipatory bail is thus disposed of.

Case diary be returned.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
