No. 29 CHC Rejected C.R.M.(A) 1996 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Raghunathganj Police Station Case No. 808 of 2021 dated 18.12.2021 under Sections 143/341/323/325/326/506/34 of the Indian Penal Code and Charge sheet being No.492 of 2022 dated 07.07.2022 under Sections 143/ 341/ 323/ 325/ 326/ 506/34 of the Indian Penal Code and added Section 302 of the Indian Penal Code.

And In the matter of : Obaidur Rahman @ Tony ...... petitioner Ms. Shabana Hasin ....for the petitioner Mr. Madhusudan Sur, Ld. A.P.P.

Mr. Arabinda Manna ....for the State The police case is dated December 18, 2021. Chargesheet in respect thereof was submitted on July 7, 2022. A person was murdered.

Materials in the case diary including statements of four eyewitnesses implicates the petitioner in the incident of assault resulting in the murder of the victim.

Considering the gravity of the offence, involvement of the petitioner therein and his long absconsion, we are unable to grant anticipatory bail to the petitioner.

CRM (A) 1996 of 2023 is rejected.
