An affidavit of compliance has been affirmed by the contemnor and filed before this Court.

It appears therefrom that the private respondent has made construction of pucca structure over an undivided plain land without obtaining any permission from the Panchayat.

The Pradhan has already forwarded the inspection report to the Sub-Divisional Officer, Ghatal Sub-Division, Paschim Medinipur for taking appropriate action in accordance with law.

As it appears that the Pradhan has already come to a finding that the construction has been made without obtaining any permission from the competent authority and the matter has already been referred to the Sub-Divisional Officer, accordingly, leave is granted

to the petitioner to follow up the matter before the SubDivisional Officer for demolition of the unauthorized construction that has been made by the private respondent.

No further order is required to be passed in the present contempt application.

The contempt application stands disposed of.

Leave is granted to the learned advocate appearing for the petitioner to communicate this order to the Sub-Divisional Officer, Ghatal Sub-Division, Paschim Medinipur for taking necessary steps in the matter in accordance with law.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
