And In Re : Minarul Sekh @ Monirul Sardar ..... petitioner Ms. Chandrima Debnath ... for the petitioner Mr. Swapan Banerjee Mr. Suman De ... for the State Learned Counsel for the petitioner submits he is in custody for more than three years. He prays for bail on the ground of delay in trial.

Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. Bail prayer of the petitioner was rejected in February, 2023. Direction was given to the trial court to conclude the trial as expeditiously as possible preferably within one year from the next date fixed for recording evidence. Time frame has not expired as yet. Under such circumstances and in view of statutory restrictions under Section 37 of the NDPS Act, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
