No. 29 CHC Rejected C.R.M.(A) 1577 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Raiganj Police Station Case No. 833 of 2023 dated 03.08.2023 under Sections 302/34 of the Indian Penal Code and Charge-sheet has already been submitted being Charge Sheet No.1023 of 2023 dated 31.10.2023 under Sections 302/34 of the Indian Penal Code.

And In the matter of : Nur Islam @ Khekanu & anr. ...... petitioners Ms. Busra Khatun ....for the petitioners Mr. Avishek Sinha, Mr. Arup Sarkar ....for the State Petitioners pray for anticipatory bail.

Involvement of the petitioners in an incident of murder transpires from five eyewitnesses recording statements under Section 161 of the Criminal Procedure Code.

Considering the gravity of the offence and the involvement of the petitioners therein as transpiring from the materials in the Case Diary, we are unable to grant anticipatory bail to the petitioners.

This application for anticipatory bail is, thus, rejected. CRM(A) 1577 of 2024 is disposed of.
