Imam Mr. Sandip Kundu .....For the State It appears that due to non-appearance of the petitioner after the charge sheet was filed against him under Sections 409/34 of the Indian Penal Code, 1860, in connection with G.R. Case No. 5287 of 2014, the learned Additional Sessions Judge, Special Court, 3rd Court, Barasat, North 24-Parganas issued a warrant of arrest against him. Execution of the warrant of arrest is pending. It has been submitted by the learned advocate for the petitioner that the petitioner is ready and willing to surrender before the learned Court below on any date that may be specified by this Court.
In view of the submissions made on behalf of the petitioner, this application is disposed of with a direction upon the learned Additional Sessions Judge, Special Court, 3rd Court, at Barasat, to consider the bail application of the petitioner in accordance with law, if he surrenders before the learned Judge in the Court below within a period of eight weeks from date.
The warrant of arrest issued against the petitioner shall remain stayed for a period of eight weeks from date. If the petitioner does not surrender within the time stipulated as above, the learned Judge will be at liberty to execute the
warrant of arrest issued against the petitioner in accordance with law.
The revisional application being CRR 1540 of 2021, is disposed of.
