Petitioner approached this Court immediately after the process was issued by the learned Metropolitan Magistrate, 15th Court, Calcutta. Learned trial court was pleased after perusal of the materials that a case has been made out under the relevant provisions of the Indian Penal Code.

Having regard to the primary contentions advanced regarding the representation made by the petitioner, I am of the view that the complainant must be granted an opportunity to adduce their evidence before charge prior to interfering with the proceeding with prayers so advanced in the revisional application. No interference is called for at this stage.

Accordingly, CRR 1542 of 2021 is dismissed.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
