There is an order of status quo dated November 22, 2010 passed in the suit for partition. The order of status quo does not define the possession of the respective parties to the suit in the suit property. The order of status quo is, therefore, unworkable.

Learned senior standing Counsel appearing for the State submits that the complains receive by the police were enquired into and the police found that the disputes between the private parties are civil in nature. He refers to the order of status quo.

In such circumstances, the police acting in the manner as noted above and since there is a suit for partition pending, it would not be appropriate for the writ court to intervene.

WPA 12322 of 2021 is disposed of accordingly.
