In the matter of : Suma Guha ..... petitioner Mr. Sabyasachi Banerjee Ms. Aafreen Perveen ....For the petitioner By an order dated January 19, 2021, the learned Magistrate in the Court below passed a direction upon the opposite party no. 2 to pay maintenance of Rs.45,000/- per month in addition to the monetary relief under Section 23 of the Protection of Women from Domestic Violence Act, 2005. The petitioner suggests that due to non-compliance of the said order dated January 19, 2021, she has filed an execution case being M. Execution No. 17 of 2021.

Mr. Banerjee, learned advocate appearing for the petitioner, submits that the opposite party no. 2 is avoiding payment of maintenance, and an order should be passed upon the learned Magistrate in the Court below to expedite the said execution. This revisional application is disposed of with a direction upon the learned Judicial Magistrate, 1st Court, Bidhannagar, North 24-Parganas, to expedite the execution case so that the unpaid maintenance is paid to the petitioner in accordance with law.

The revisional application being CRR 1533 of 2021 is disposed of.
